RESUMO:

The article 225 of the Brazilian Federal Constitution advocates for the collective right to an ecologically balanced environment and imposes the responsibility for protecting and preserving water resources for future generations. Upon analyzing the issue of urban spring recovery, often overlooked, it becomes evident the specific and characteristic hurdles to fulfilling this constitutional mandate. However, despite of the urban headwaters being susceptible to environmental degradation, given the reality of brazilian cities, their restoration proves feasible through sustainable and collaborative practices. Consequently, the heightened collective awareness and the concerted efforts across different social sectors can converge towards implementing preservation measures outlined in current environmental regulations. This dissertation has the objective to document the legal conceptualization of springs and the legislative instruments intended for their recovery. In this context, an assessment was conducted on the procedural and environmental status of ten water springs located within the municipal jurisdiction of Cuiabá, with the ultimate goal of selecting methods and defining approaches for the recovery of this vital water resource. Thus, it is evident that the substantiation of legal and environmental protection mechanisms for the natural environment should be based on the confluence of collective consciousness dedicated to safeguarding springs.
