RESUMO:

This study takes as its research corpus the short stories “Um gentil ladrão” (2020) and “A imortal quarentena” (2020) by Mia Couto, upon which it develops an inquiry into “Law in Literature” through the interdisciplinary relationship between Literature and Law. It proceeds from the premise that Literature serves as a witness to social reality, and, since Law is an essentially social phenomenon, it follows that fictional texts may contain representations pertaining to the legal sphere. The overall aim is to conduct a critical study of “Law in Literature”, using the selected stories to examine the violations of fundamental rights in the covid-19 pandemic in Mozambique. This qualitative research is grounded in a literature review across both fields to address the proposed components, taking two short stories as an entry point to  comprehend this complex context. The inductive method enables a broader understanding of the pandemic moment, which took society by surprise on a global scale. As theoretical support for the interdisciplinary study between Literature and Law, we draw on the propositions  of Godoy (2002, 2008) and Olivo (2005, 2010), as well as arguments by the literary theorist Candido (1989, 2011) regarding Literature, used to contribute to the interdisciplinarity under discussion. For an overview of Mozambican literature, we rely on Macêdo and Maquêa (2007), Fonseca and Moreira (2007), and Noa (2019a, 2019b). Regarding the short story genre, key references include Bosi (1977), Gotlib (1998), and Magalhães (1972). For the analysis of fundamental rights and a historical overview of the Mozambican Constitution, we draw on studies by Chaimite (2021, 2023), Gabriel (2014), and Gouveia (2015), among others. Fundamental rights are guiding elements of a Democratic State governed by the rule of law and represent important social achievements. Their violation also entails a violation of human dignity. It is therefore crucial to maintain close attention to the realization and protection of these rights, which, in this study, are examined through their concrete effects on society.
